DUI Charges for NASCAR Chairman France

Sag Harbor Village Police officers arrested Brian France, NASCAR CEO, for driving under the influence and criminal possession of oxycodone. Brian France had a blood alcohol content more than twice the legal limit while driving in Long Island, NY.

As with the majority of the states, the legal BAC (Blood Alcohol Concentration) limit in the state of New York is 0.08%. The NASCAR CEO France’s BAC was 0.18%, more than twice the legal limit. In some states, such as Arizona, having such a level of alcohol in the system is a more extreme offense than a regular DUI. Sometimes these offenses carry names like a “Extreme DUI” or a “Super Extreme DUI“.

The NASCAR chairman, according to arresting officers in Sag Harbor, failed to stop at a stop sign. Though failure to stop is just a low level misdemeanor, additional charges can always be filed once a person is observed and suspected of driving under the influence. This was exactly the case with France as officers stated that he (France) smelled of alcohol, and displayed slurred speech. France was arrested on August 5, 2018 for DUI and criminal possession of a controlled substance.

According to the Sag Harbor Village Police department, officers witnessed French driving his vehicle in an intoxicated condition. French was pulled over by the police and was given field sobriety tests. Next, officers found oxycodone pills after searching his person. France spent the night in jail, then was arraigned at Sag Harbor Village Justice Court and released.

French did make a statement, in which he apologized to the NASCAR industry and fans. He announced he would be taking a leave of absence from his leading position at NASCAR. The leave of absence may be as much as a public relations move as it is time for France to recompose himself following the charges.

Bill France Sr., Brian’s grandfather, founded the NASCAR company in 1948. Brian France is a third-generation executive of NASCAR. This DUI arrest definitely leaves a bit of a black eye on the founding family. ESPN reported that France may be required to undergo drug suspension, a recovery program, and a period of suspension.
